Undocumented immigrants can receive DC workers' comp benefits

Where a worker is injured in the course and scope of his employment turns out to be "undocumented," the DC Court of Appeals has ruled that workers’ compensation benefits should still be paid. The District of Columbia’s highest court ruled against the disabled busboy’s employer which contended that an illegal immigrant cannot receive workers’ compensation. The D.C. Court of Appeals, however, ruled the man who was struck in the eye and blinded may now receive about $11,000 in compensation benefits. The Washington D. C. Office of Workers’ Compensation awarded benefits and the appeals court ruled that is legal under the District’s workers compensation laws because, in part, doing so is "consistent with the principle that the [workers’ compensation] Act is to be construed liberally to achieve its humanitarian purpose."
