Unlike baseball team box scores, the approval rates of the Federal Administrative Law Judges who decide Social Security Disability cases are not published in the daily newspaper. The answer to this question used to be difficult and we could only use our own actual experiences and the data from other lawyers with whom we share information at the American Association for Justice, NOSSCR and the Virginia Trial Lawyers Association. However, now you can get several years of results of many Social Security Administrative Law Judges ("ALJs"). In response to a Freedom of Information Act ("FOIA") request by The Oregonian newspaper, the Social Security Administration ("SSA") released the production numbers and approval rates for all of its Administrative Law Judges. The agency released complete reports for 2005, 2006 and 2007. The table for 2008 covers most — but not all — of the year. While we prefer to rely on our own experience in front of particular judges and SSA staff, utilizing this information can also be helpful.
