Models can make the case; injuries AND Dangers require illustration

While photographs in slip trip and fall accidents can be critical evidence, not every injured victim has photographs of the scene, the defective stairs or dangerous parking lot before changes were made or repairs instituted. And many courts will not allow pictures of the scene after it has been altered or repairs completed. In a recent case where a set of defective steps caused an ABRAMS LANDAU client to injure both legs, it was felt that the post accident pictures were not sufficient to show the jury the nature of the danger to the injured worker.

So Herndon and Reston workplace injury lawyer Doug Landau had a scale model of the staircase made for use in court. The stairs showed how the second stringer separated fro the landing, causing the plaintiff to fall and injure his ankles. The model also demonstrated how the stairs looked BEFORE the plaintiff was thrown down to the cement basement floor. Plus, the model made a sharp sound when the steps suddenly slipped off the landing, unsecured, that would capture the jurors’ attention and be remembered in deliberations. When aerial photographs, street scene photographs and actual photos are not sufficient, then scale models can help prove the defendant’s negligence so that full and fair compensation for what has been taken from the plaintiff can be accomplished.
