Maryland District Court cases may amend rules to hear cases up to $20,000

Legislation is pending in Annapolis that will permit voters to decide this November whether to amend the Maryland Constitution to limit the right to jury trial in civil cases to those suits where the amount demanded is $20,000.00 or greater. The current threshold is $10,000. The bills are HB 434 and HB 436. At ABRAMS LANDAU, we strongly supports this legislation. While our law firm, like the Maryland Association for Justice, recognizes the importance of the right to jury trial, it also recognizes that smaller cases involving less than $20,000.00 would be more efficiently and expeditiously resolved in the District Court system. This is not just cases involving contract breaches, small claims, property damage and personal injury, but a wide variety of cases involving citizens of the state of Maryland. Insurers commonly file jury demands in smaller cases to needlessly delay and complicate the fair and prompt resolution of such cases. This legislation will end this unfair practice and benefit all future civil litigants. If you live in Maryland, please call or email your Delegate, to urge them to vote for HB 434 and 436.
