Garbage truck strikes newspaper deliveryman and renders him quadriplegic

Having been a newspaper delivery boy as a teenager, Doug Landau remembers the cold, wet and dangers associated with going on his route door to door on foot and by bike for the Bergan Record Newspaper. In this case, the plaintiff was delivering newspapers for the Washington Post. During Christmas week he was involved in an accident with a garbage truck owned by Defendant Potomac Disposal Services of Virginia. The garbage truck was backing up when it collided with plaintiff’s 1990 Jeep Cherokee.

Plaintiff’s counsel alleged that the defendant’s driver suddenly backed into a street while plaintiff was driving 20 mph. The plaintiff deliveryman claimed his spinal cord was injured and he was rendered a quadriplegic as a result of the accident. He has been in a nursing home, hospital or rehabilitation facility facility since the accident. Defense counsel contended that plaintiff was contributorily negligent because defendant’s driver backed up slowly and stopped every few seconds and plaintiff could have avoided the accident.

The injuries alleged by plaintiff include spinal cord injury resulting in quadriplegia, pneumonia, sepsis, a urinary tract infection and bed sores during his hospitalization. The enormous medical specials (bills related to treatment) was a factor in the parties reaching a $12,000,000 settlement prior to trial.
